The "How To" Series: Probate Fights (Litigation)

No matter who you are…no matter where you’re from…at some point in your life, you have to fight!

While the fight doesn’t always mean going toe-to-toe in the school yard with the neighborhood bully, it may mean standing up for yourself when someone else pushing you around. For some, fighting is a natural instinct. For others, it’s one of the scariest times of life. It can be a feeling totally foreign to someone who usually avoids conflict. In situations where someone is pushing you around in a legal context, the process can be ever more frightening. Being in conflict + the cost of lawyers + the uncontrolled feeling of being in the legal system can = misery. Thankfully, there is help…

Winning a legal fight starts with standing up for yourself when someone is pushing you around. Consider the advice you would give to a friend or a child when someone is picking on them – you’d probably say “Stand Up for yourself!”. You should, too! Don’t shy away from conflict because you’re intimidated or scared of being hit. The fact is – most bullies run when confronted. As an old friend used to say, “if you’re getting picked on, hit the bully once in the nose as hard as you can, and he’ll think twice about coming in for seconds.” The same is true here. Stand up and fight.

Once you’ve made the decision to fight back, give some thought to the best strategy. Often, this starts with finding the best legal representation you can afford. While lawyers may be everywhere, bluntly, not every lawyer is created equal. You need someone who is an expert in your case, someone who will impress (or scare) the other side, and an advocate who will zealously represent your interests. Avoid unethical lawyers like the plague and opt only for those who have proven records of advocacy within the rules of professional conduct and the law. A solid legal team can be the difference between a big courtroom win and picking yourself up off of the playground floor with a bloody nose.

Finally, be committed to the fight. Trust your lawyers and their plan for success. No matter if you win or lose, you’ll be glad that you stood up for your rights and didn’t back down. If you’re in a fight in probate court, call us today.
